In consideration of the Griffith University Gold Coast Student Guild (GUGC Student Guild) selecting me for and partially funding my participation in the Griffith University Gold Coast Team (the “Team”) to the Northern or Australian University Games or Championships, I agree to abide by the following terms and conditions. I also understand and agree that this agreement must be signed by me before departure and if it is not so signed, I further understand that I will not be able to travel to the host city or compete as a member of the Griffith University Gold Coast Team for the purpose of competition.
1. I declare that I am eligible to compete for the Griffith University Gold Coast in accordance with the Eligibility Guidelines.
2. I acknowledge that the Griffith University Gold Coast Student Guild is the organising body responsible for this tour and accordingly agree that this Agreement shall have precedence over any Agreement that I may have with, or instructions I may receive from any National Federation (“NF”), any sponsor of this NF, any employer, manager, agent, consultant, adviser, coach of mine or any person or body, corporate or unincorporated with whom I may have contracted to endorse or publicise goods or services.
3.1 To observe and comply with each and every term and condition of this Agreement, the Constitution and By-Laws of the GUGC Student Guild (as amended from time to time), including, but not limited to, the Doping Policy which is the Doping Policy of the International Olympic Committee (IOC).
3.2 To be subject to the reasonable control, management and directions given by the Team Manager and any person appointed by him/her.
3.3 To observe and comply with all reasonable directions given by the Team Manager and any person appointed by him/her.
3.4 To conduct myself in a proper manner so as not to bring myself, GUGC Student Guild, or the Team into public disrepute or censure and to absolute satisfaction of the Team Manager.
3.5 To abide by the Australian University Sport (AUS) Codes of Behaviour.
3.6 Not to make, comment, issue, authorise, offer or endorse any public criticism or statement having or designed to have a prejudicial effect on the interests of the GUGC Student Guild, or the Team or any Member of the Team.
3.7 To travel and depart for the Tour upon dates and in the manner determined or approved by the GUGC Student Guild, or as directed by the Team Manager.
3.8 To conduct myself in such a manner as to obtain and maintain my best possible physical fitness and health to carry out my duties to the Team to the best of my ability.
3.9 To pay for any damages caused by my actions or myself.
4.1 Pursuant to the Olympic Charter the IOC has established as medical code which, among other things, provides for the prohibition of doping, establishes lists of classes of prohibited medicaments and procedures, obligates competitors to submit themselves to medical controls and examinations, prohibits the trafficking of prohibited drugs and makes provisions for sanctions to be applied in the event of a violation of the medical code.
4.2 I agree to comply with the Medical code of the IOC.
4.3 I will not use, attempt to use, have in my possession, attempt to have in my possession, traffic or attempt to traffic a drug of dependence (as each of these words or phrases are defined in the Drugs Poisons and Controlled Substances Act 1981 of the state of Victoria).
4.4 I will not take substances or use methods prohibited by the IOC as referred to on the IOC list of Doping classes and methods.
4.5 I will provide a sample for testing if and when requested by a drug testing authority recognised by AUS.
4.6 I will not assist or be involved in a Doping Practice.
5.1 I will not compete in any AUS sporting event if suffering the obvious effects of alcohol.
5.2 As a spectator, I will not consume alcohol while an AUS sporting event is under progress except at times and places approved by the Host.
6.1 I authorise any medical practitioner, sports scientists or therapist whom I have consulted during the 12 months preceding the commencement of the Tour to provide details of any illness or injury which I have sustained or any pre-existing medical condition to the Team Officials if and when required by them. I understand that such information is required solely to determine my medical fitness to carry out my duties to the Team to the best of my ability.
6.2 I agree to comply with all reasonable directions given by any Medical Officer appointed to the Team.
6.3 I agree to complete the attached medical form prior to departure.
I agree to observe and comply with the following media guidelines:
7.1 The spokesperson on all matters concerning the Team will be the Team Manager or his/her delegate or nominee from team management.
7.2 Players will only be entitled to communicate directly with the media when accompanied by the Team Manager or such other member of the management Team as may be designated by the Team Manager.
7.3 I consent to the publication and/or use in any form of media whatsoever of my name, image, statements or otherwise, without payment or compensation.
8.1 That I will wear the clothing distributed to the Team as determined by the Team Manager from time to time including any other formal event as may be scheduled.
8.2 That I will wear the approved uniform during competition whilst competing for my University. I understand that my coach may direct the type of clothing I should wear for practice.
8.3 To maintain my team issued clothing and competition gear in good clean condition.
9.1 Any incidences arising from a breach of this agreement shall be dealt with at the discretion of the Team Manager.
Any breach of any part of this agreement may result in the following:
(a) Termination of membership of the Team.
(b) An order to leave the Tour and return to the Gold Coast. Any additional costs for this to be met by the individuals or teams concerned.
(c) Exclusion from all or part of the competition.
(d) Retention of bond.
(e) Referral to the AUS Disciplinary Committee
10. RELEASE AND INDEMNITY
10.1 For the purpose of this clause GUGC Student Guild shall mean and include the Griffith University Gold Coast Student Guild, its members and Executive, officials, coaches, medical practitioners, sports scientists, therapists and members of the Team and any independent contractor from time to time employed by the GUGC Student Guild or any voluntary worker carrying out honorary or unpaid duties for the GUGC Student Guild.
10.2 I expressly agree that the GUGC Student Guild shall not in any circumstances whatsoever be under any liability whatsoever to me for any loss, damage or injury of whatsoever kind arising directly or indirectly from any act, neglect or fault (whether negligent or otherwise) on the part of the GUGC Student Guild and connected with my membership with the Team, my participation in the Tour, and disciplinary action taken against or directed at me by the GUGC Student Guild, and hereby indemnify and will at all times hereafter and well and sufficiently indemnify and keep indemnified the GUGC Student Guild from and against all actions, suits, causes of actions, proceedings, claims, demands, costs and expenses whatsoever which may be taken or made against the GUGC Student Guild in conjunction with or arising out of any such loss, damage or injury and hereby agree (without obligation upon the GUGC Student Guild to do so) that the GUGC Student Guild may act as my agent in incurring such expenses as and/or doing whatsoever is reasonably necessary for the benefit of me in connection with or arising out of any such loss, damage or injury.
10.3 I acknowledge and agree that in entering into this Agreement that in particular but without limiting the generality therefore, for the purpose of the clause the GUGC Student Guild is, and shall be deemed to be, acting as agent and trustee on behalf of and for the benefit of all persons and bodies, corporate and unincorporated who are or might be its members and executives, officials, servants or agents (including the officials, coaches, medical practitioners, sports scientists, therapists and members of the Team and any independent contractor from time to time and voluntary, honorary and unpaid workers as mentioned in this clause) and all such persons shall to that extent be or be deemed to be parties of this Agreement.
11. GUGC STUDENT GUILD OBLIGATIONS
In consideration of you as a Player, Coach, Manager or any other team entering into this Agreement and paying a sum certain to the GUGC Student Guild, the GUGC Student Guild undertakes to:
11.1 Arrange accommodation as required for the Tour’s duration.
11.2 Arrange for transport to the host city and back to the Gold Coast if deemed necessary by Team Management.
11.3 Arrange for members of the team to purchase items of clothing that constitute a team uniform.
11.4 Keep you informed and answer your questions prior to and during the Tour.
11.5 Provide the necessary administrative, managerial and infrastructure support necessary to ensure the best possible performance of team members.
12. PROPER LAW
12.1 This Agreement shall be governed by the laws of the State of Queensland and the parties hereto agree to submit to the jurisdiction.
